LaMichael James arrested for alleged domestic violence
According to Addicted To Quack, Oregon Running Back LaMichael James has been arrested early this morning for alleged domestic violence. Read more here:
The Lane County Sheriff's Office website lists James' charges as strangulation, Assault 4 and menacing.
Apparently, all three charges are misdemeanors, which seems odd to me. Nonetheless, given the legal miasma surrounding Oregon QB Jeremiah Masoli earlier this year, this does not reflect well upon Chip Kelly's squad up there.

Apparently, there was a recent attempt to make strangulation a felony in Oregon. From a Google search:
Perhaps the single most glaring example of legislative discrimination currently on the books is Oregon House Bill 2770, which was originally set to make strangulation a felony. It was stripped of this provision ostensibly "because of the cost." It is a mere misdemeanor to strangle someone, so long as they eventually regain consciousness.
This may or may not be the official language from the Oregon statutes:
A person commits the crime of strangulation if the person knowingly impedes the normal breathing or circulation of the blood of another person by:
(a) Applying pressure on the throat or neck of the other person; or
(b) Blocking the nose or mouth of the other person.
(2) Subsection (1) of this section does not apply to legitimate medical or dental procedures or good faith practices of a religious belief.
(3) Strangulation is a Class A misdemeanor. [2003 c.577 ยง2]

But (a) could be choking or strangulation, depending on where pressure is applied. Choking blocks air flow, strangulation blocks blood flow! Just like in football, technique is so important!
and (b) is clearly suffocation.

Section 163.190 of the Oregon Revised Statutes provides:
(1) A person commits the crime of menacing if by word or conduct the person intentionally attempts to place another person in fear of imminent physical injury.
(2) Menacing is a Class A misdemeanor.

James has been charged with assault-4, which is a misdemeanor that carries a potential one-year prison term, as well as with strangulation and menacing, both misdemeanors.
According to Sgt. Tom Borchers of the Springfield Police Department, James was taken into custody Tuesday, a day after getting into a fight with his girlfriend.
Jamesโ girlfriend, according to the police report, said the running back grabbed her around the neck and pushed her to the ground. She complained of pain to her neck and of abrasions from being pushed down in a parking lot.
It is not the first arrest for James, a 20-year-old from Texarkana, Texas, who was a redshirt freshman in the 2009 season. James was arrested and charged with disorderly conduct and third-degree battery in June 2008, just prior to arriving in Eugene.
Those charges, stemming from a fight involving rival high schools, were dismissed in July of 2009.
