DBD 6.2.09 What Pop Culture / Literary Character Are You Most Like?

Sure, it's not even close to June 2nd, but damnit, it's almost time to go to bed and posting here doesn't happen anymore. Notice me, damnit!

Actually, I've wanted to post this for a while. You always have those friends that remind you of a character from a book / movie / tv show. What characters do you think you tend to remind people of? It can be from any source, however obscure. It can be based off manner of talking, personality, sense of humour, looks, ridiculous situations, how well you relate to that character, etc.

Not to be content with just one name, I'm going to answer this question for myself this way: I'm a blend of three characters, all from pop culture.

Star-divide

Barney_medium

via z.about.com

Barney: I wear suits everywhere, think everything is "awesome", fear relationships and commitment, look down on marriage, and am all about living it up. I don't womanise like he does (not my thing, as I will discuss later), but one quote really made me realise how similar to Barney I can be at times:

Barney: I'm delightful.

Robin: To us? Sure. In very small infrequent doses.

Friends_chandler_240x260_052820041524_medium

via i.tbs.com

Chandler: My sense of humour is quite similar to Chandler's (cue Avinash: lol so ur not funny!) - constantly sarcastic and mocking. No one ever takes me seriously since I'm always joking. I've found myself in many a similar situation to him in my life.

Jughead7704799232511aj0_medium

via img403.imageshack.us

Jughead:

A strongly misunderstood character, Jughead doesn't hate girls; he simply enjoys food more. Replace food with alcohol and you have yet another component of this complex caricature we call Rishi.

So there you have it - more useless information about me than you ever wanted to know.

But, more importantly, I'm really interested to see what people here say and how they see themselves. So let's do it!

Oh, and apparently Cal has some sort of forward-passing rugby team with some kid named Jahvid Best.

The opinions expressed in a FanPost are, in every way, reflective of the opinions of every California Golden Blogs Marshawnthusiast. Moreover, they are reflective of every employee of SBNation, including Tyler "Blez" Bleszinski.

I believe that’s “Jahveed Best.”

(Seriously I’ve listened to a few podcasts from the EDSBS guy and he seems convinced “Jahvid” isn’t pronounced phonetically. It’s mega-wack.)

Nobody can pin me down either. I’ve gotten like 10 idks, plus: Mac Dre (I have no idea), Stephen Colbert (because I tell jokes?), Lance Armstrong (because we both had testicular cancer, apparently…), Bruce Willis (my sister has finals and wants me to shut up), and Donald Duck (what?). Everyone else said they could not find a good comparison. All the people who answered me didn’t find a good comparison either.

Since this seems to be a big pop culture DBD

The Ten Most Influential Films of the Past Ten Years.

For those who just want the list: Bourne Ultimatum, Sky Captain, Greek Wedding, Traffic, Polar Express, Rushmore, Matrix, Children of Men, 40 Year Old Virgin, Coraline.

I’m not a fan of tearing down lists, so can anyone find films from the past decade that have been more influential?

by Avinash on Jun 2, 2009 1:34 AM PDT reply actions   0 recs

X-Men (2000)

Surprised that one wasn’t one there – it was the first of the ‘new’ comic book movies, and spawned the trend we see today. It grabbed people’s attention in a way that the Superman movies of the 80’s didn’t. It had a bit of a darker edge that hadn’t been seen in comic book movies. For any depth that Christopher Reeve and Margot Kidder might have to the Superman movies, Gene’s Hackman’s campy portrayal of Lex Luthor was there to cancel it out. X-Men didn’t have that – it had better actors to bring more depth to the characters, and a villain who was easily willing to sacrifice the life of a young girl to achieve his aims. It doesn’t have the depth of some of the more recent fare, but should be acknowledged for its pioneering role.

[incidentally, I’m not counting Blade (1998) because a) hardly anyone knew it was a comic-book movie, b) its source material wasn’t popular enough for it to have a wide impact, and c) it was made more than 10 years ago]

I haven't seen that many tear-stained dollar bills since my dad hired a stripper for my uncle's funeral.

The Dark Knight (2008)

This one’s a little tougher, because it’s a movie whose full impact won’t be felt for years to come, but the shock waves have already begun, and will only continue to grow in the forseeable future. This one is a game-changer.

True, Batman Begins (2005) was genre-bending and broke open our minds to new possibilities, but it was The Dark Knight that truly shattered the boundaries. This was the comic-book movie as psychological thriller. This was the comic-book movie as gritty crime drama. This was taking-you-to-the-bad-place-and-not-letting-you-up-for-air. Sam Raimi has already said that that this film has ‘upped the ante for superhero movies’. Talk about an understatement.

The Dark Knight is the Albert Pujols of comic-book movies – we know it’s amazing now, but we still can’t fully understand the effect it will have down the line until we get there. Only time and patience will reveal the full effect of its influence.

Really?

You want to get into a debate as to which movie is more entertaining? It boils down to personal taste, there is no quantifiable justification for liking one movie over the other. Furthermore, nothing is achieved. Its like arguing that peas are better than carrots.

You are right about everything!

Only when you say carrots, you should say Peas. Why you might ask, because I find the colour green more appetizing than the colour Orange. Also, one can collect a mouth full of peas, then pretend they are a sprinkler shooting them out of your mouth and towards all your friends. Yes, you can perform fellatio on a carrot, but I don’t really care to perform fellatio period.

Why is Borne Ultimatum & 40 year-old virgin on the list? Seriously, I’d like to know the logic.

Anyway, I would say Daywatch and Nightwatch, were pretty ground breaking, the problem is they are russian movies so no one recognizes them.

I’d also say 28 Days later, Once (redefined what a musical is)

Was Memento within the last 10 years? That’s it for now, I’m sure I’ll think of some others.

Brokeback Mountain

While not one of my personal favorites (and so no bias based on my personal taste in films is involved), I think Brokeback Mountain was one of the most influential films in the last 10 years, because it showed what great acting can do when you take 2 of Hollywood’s best actors and put them in a controversial film in uncomfortable roles, and they knocked it out of the park.

To me, technology or no technology, this film redefined the essence of acting in its purest form.

California women’s tennis senior Claire Ilcinkas received her third selection to the Pac-10 Conference All-Academic team as Commissioner Tom Hansen announced the 2009 Men’s and Women’s Tennis All-Academic teams Monday, June 1. Ilcinkas took her second consecutive spot on the first team (2nd team in 2007) and was joined by fellow seniors Bojana Bobusic and Marion Ravelojaona and sophomore Marina Cossou, whom each received honorable mention. For Bobusic, it was her third such honor.

To be eligible for selection to the academic team, a student-athlete must have a minimum 3.0 overall grade-point average and be either a starter or significant contributor. An economics major with a 3.69 GPA, Ilcinkas was an instrumental piece to a run that led the Golden Bears to their second consecutive NCAA runner-up finish. She logged a 31-10 singles record and posted a 20-4 mark in dual matches. In doubles play, Ilcinkas added 25 victories as she was selected to compete in both the NCAA singles and doubles championships.

California men’s tennis senior Geoff Chizever and sophomore Bozhidar Katsarov received second-team honors as Pacific-10 Commissioner Tom Hansen announced the 2009 Men’s and Women’s Tennis All-Academic teams Monday, June 1. Sophomore Jonathan Dahan was selected for conference all-academic honorable mention. To be eligible for selection to the academic team, a student-athlete must have a minimum 3.0 overall grade-point average and be either a starter or significant contributor.

Chizever, an interdisciplinary studies major (3.37 GPA), earns his second selection to the all-academic team as he led the Golden Bears to 14 doubles-point victories in 22 matches this season. He and partner sophomore Pedro Zerbini posted a team-high 25-13 doubles record as they won the 2008 Wilson/ITA Northern Cal Championships doubles title. The two were subsequently selected to the NCAA doubles championship where they advanced to the round of 16. Katsarov, undeclared major with a 3.68 GPA, recorded 15 singles wins with 12 coming in dual matches to go along with 14 doubles victories this year. Dahan was third on the team with a 17-11 singles record and added nine doubles wins. Katsarov and Dahan are each first-time selections to the all-academic team.

A whopping 22 from women's crew
LINK

Pac-10 champion California placed 22 Golden Bears, including six from the varsity 8+, on Pac-10 All-Academic teams, the conference announced last week. Seniors Elena Humphreys and Lou Kinder from Cal’s varsity 8+ earned spots on the first team along with senior Vanna Rocchi and junior Shay Seager from the second varsity 8+, which finished second in the grand final of the recent NCAA Women’s Rowing Championships. The Bears finished second overall in the national regatta, which took place May 29-31 at Lake Natoma in Gold River, Calif.

Cal placed 14 student-athletes on the all-academic second team – sophomores Bridget Moran (2V8+), Avalon Radys (3V8+), Jenny Rusher (3V8+) and Claudia Walterspiel (3V8+); juniors Kirsten Campbell (2V8+), Jill Costello (2V8+, coxswain), Adrienne Keller (2V8+), Laurel Kuhn (2V8+), Katie Luke (2V8+, coxswain), Taryn O’Connell (V8+); and seniors Melissa Herman (2V8+), Katy Milton (V8+, coxswain), Kaiti Seders (2V8+) and Sam Silvia (V4+).

Four Bears – sophomore Danielle Detloff (3V8+), freshman Elise Etem (2V8+), sophomore Mary Jeghers (V8+) and senior Lauren Nowinski (V8+) – earned honorable mention distinction.

Men's crew gets a modest 14
LINK

California men’s crew, in the midst of preparations for the annual IRA Regatta, placed four members of its varsity 8+ on the Pac-10 All-Conference teams and 14 members of its program on the Pac-10 All-Academic teams. Junior Nareg Guregian, sophomore Nick Lucey, senior Jan Tize and junior Nikola Zunic from Cal’s varsity 8+ earned spots on the Pac-10 all-conference team. Zunic was also among 14 Bears who were awarded all-academic first team, second team or honorable mention status.

This is the second all-conference honor for Tize, who along with Guregian, Lucey and Zunic won the Pac-10 varsity 8+ title on May 17 at Lake Natoma in Gold River, Calif., the site of this week’s IRA Regatta. That boat’s victory in the last race of the day propelled Cal to the overall team crown at the Pac-10 Rowing Championship.

Cal put three Bears on the Pac-10 All-Academic first team – senior Janis Fontein (varsity 8+) and juniors Matt McLaren (V4+) and Jack Zhou (V4+, coxswain) – 10 Bears on the second team – juniors Will Dean (2V8+), Sean Engel (V4+), Kirk Halterman (open 8+), Jimmy Henson (novice 8+), Jordan Sartor (V4+) and Zunic; and seniors Jarrod McClendon (open 8+), Michael Porter (2V8+, coxswain), Geoffrey Roth (2V8+) and Axel Stelter (V8+). Cal sophomore Will Kolbe (open 8+) earned honorable mention.

Sports

YO on Lindy’s:

–USC’s visit to Cal on Oct. 3 is listed as one of the top 12 conference games across the nation this season.

–Lindy’s selected an all-decade team and Alex Mack was the second team center.

–The publication lists its top 100 recruits for 2010 and two Cal commits are among the rankings: quarterback Austin Hinder checks in at No. 76 and linebacker Cecil Whiteside is No. 91.
Wilner’s being a dick

But unofficially, the pressure has been turned on the Cal program for 2009.

The summer magazines are out and so are their national rankings — and these magazine rankings give us a pretty good idea where Cal will land in the preseason polls, which help establish the (external) pressure and expectations on various teams and coaches.

Bottom line: The college football world will have high expectations of the Bears, which as we’ve seen over the years isn’t necessarily the best thing for Cal.

The Bears do not always respond well to pressure and are more likely to underachieve than overachieve — not since 2004 have they finished the season ranked higher in the AP poll than where they started.

Let’s start with the ‘09 magazines …

* Cal’s ranked No. 11 by Athlon’s.

"If the passing game emerges, Jeff Tedford’s club could be in position to challenge USC for supremacy in the Pac-10." (Quote by Athlon’s editor taken from Cal’s website.)

* Cal’s ranked No. 12 by Lindy’s, behind USC

Says the mag: "With 15 starters back from a nine-win team, the Bears can push USC for the Pac-10 championship. It’s just that the Trojans always push back harder."

* Cal’s ranked No. 21 by Sporting News, behind USC and the Oregon schools.

Says the mag: "If the Bears had a few more players like the electrifying Jahvid Best, the Pac-10 could be a four-team race."

Given those rankings and my experience as an AP voter — not only in voting but in talking to other voters — the guess here is that Cal will land in the No. 10-15 range in the AP preseason poll.

That doesn’t bode well for the Bears in the post-Aaron Rodgers era.

He ends it with:

Maybe that all changes in ‘09.

Calogne on the rookies:

The Carolina Panthers have been trying to find backup linemen and a starting long snapper. Cal’s Nick Sundberg is in the hunt for the long snapping chore, but there’s still an awful lot of talk about the Panthers bringing back their former long snapper, Jason Kyle, this coming season. It doesn’t seem as though the Panthers are listening much to the talk just yet.

One of Cal’s favorite linebackers, Zack Follett, is fast becoming a favorite in Detroit – especailly after vowing to knock every player drafted ahead of him out of the games that he plays them in. For now, his biggest obstacle is learning the defensive playbook being installed in Detroit by former Raiders and Chiefs defensive guru, Gunther Cunningham.

The Chicago Bears have been sending their rookies all over the surrounding area to help the community. Undrafted rookie Will Ta’ufo’ou has been one of those rookies listed. Whether it’s promoting the importance of daily physical activity or refurbishing a teen center for the Boys and Girls Club of Lake County in Waukegan, the Bears rookies are putting in the time for good causes.

One thing forgotten with the drafting of Cal’s Alex Mack with the 21st pick was that Cleveland already had a pretty good player starting at Mack’s position. Hank Fraley told reporters that he’s ‘a team player’ and has already shared with the rookie lessons he learned about being a professional football player. So far, Fraley has good reviews of the 2009 Draddy Trophy recipient.

Rags is a lucky man indeed.

But I have a question about the results. How can hetero couples have more anal sex than homosexual couples? Isn’t sex between two men by definition going to include anal sex? Do they mean the number of times in a week that the couples have anal sex? That would just mean that hetero couples have sex more often than homosexual couples.

Because there are a lot more hetero couples than homosexual couples…

by HolmoePhobe on Jun 2, 2009 10:56 AM PDT up reply actions   0 recs

Oh, I missed the “in absolute numbers” part. Well that goes without saying, but what’s the point of that statement? If homosexual couples make up only like 10% of the population, it would simply take 11.1% of heterosexual couples (10% of the 90% of couples that are hetero) to have anal sex, to have more anal sex in absolute numbers.

Is it easy to believe that 11% of hetero couples are having anal sex?

Jahvid Best is so awesome, he makes me want to strangle a mountain ox with my bare hands!

by dballisloose on Jun 2, 2009 11:00 AM PDT up reply actions   0 recs

follow on statistics from the 2000 census:

The report showed about 54.5 million married-couple households and 5.5 million unmarried-partner households. Of those unmarried partner households, only 594,000, about 1 in 9, were same-sex partners, making homosexual partners only one- or two-tenths of one percent of the nation’s couples.

So if homosexual couples are 0.2% of the population, then it only takes 0.2% of the heterosexual couples to have anal sex to have more anal sex in absolute numbers.

What do you think, 0.2% of hetero couples having anal sex out there? That’s only 1 in 500 straight couples have anal sex, which is totally believable. So yes, now I’m convinced that straight couples do indeed have more anal sex in absolute numbers than homosexual couples.

Number of same-sex households are a) underreported b) not an accurate measure of the number of gay couples having sex as social pressures may discourage the establishment of a same-sex household.

Will the Bears finally respond to playing well under pressure?

And do you agree that Wilner has failed?

I know carp posted the link, but I’ll post the part of the story I’m using for the question he asked

But during the four-season stretch (2005-08) in which Cal has repeatedly failed to produce a better-than-expected year, four other Pac-10 programs have pulled surprises to the upside:

In 2005, the Bruins and Ducks were unranked in the preseason and finished Nos. 16 and 12, respectively.

In 2006, Oregon State received zero votes in the preseason poll and finished No. 21.

In 2007, the Sun Devils were unranked in the preseason poll and finished No. 16.

In 2008, the Beavers were unranked in the preseason and finished No. 18 while the Ducks were No. 21 and finished No. 10.

Sure, the Bears’ sometimes-lofty preseason ranking can limit the opportunity for an upside — like in ‘06, when they were No. 9 in the preseason.

But at the same time, 0-for-4 is 0-for-4.

You’d think that just once in that window, Cal would either handle the pressure (2007, anyone?) or exceed expectations. And yet it has repeatedly failed at both.

by Avinash on Jun 2, 2009 9:42 AM PDT reply actions   0 recs

I don’t think 2006 would be considered a failure. They finished 14 instead of 9, so what? In 2008, Cal met or exceeded expectations. Only in 2005 and 2007 did Cal fail to live up to preseason hype and honestly 2005 shouldn’t have been hyped and 2007 was admittedly a disaster.

It'll be just you, me, and Peter Nincompoop.

I'm fairly certain in 2006

He’s referring to getting blasted apart in Tennessee, losing a gimme in the desert, and just playing bad, bad, bad against USC. Win one of those three and we probably go to the BCS.

by Avinash on Jun 2, 2009 9:47 AM PDT up reply actions   0 recs

I understand. But the finish and the preseason ranking really isn’t that different. And, while it is disappointing Cal couldn’t beat Arizona, the other loses are not that unlikely. The SC game was within a score of one another the entire game until late in the 4th.

It'll be just you, me, and Peter Nincompoop.

by BeastMode on Jun 2, 2009 9:51 AM PDT up reply actions   0 recs

Also, worth noting that Wilner arbitrarily picks 2005 as the cutoff, ignoring Cal’s exceeding expectations in 2002-2004.

it's just a way to stir up folks in The Offseason
But during the four-season stretch (2005-08) in which Cal has repeatedly failed to produce a better-than-expected year

Really?

2004: 13/9 (Rodgers)
2005: 19/25
2006: 9/14
2007: 12/NR
2008: NR/NR

First he belittles the ‘04 season, then he cites 3/4 seasons in where Cal finished where it was “predicted” (within an acceptable SD). Only, he’s calling these failures.

But at the same time, 0-for-4 is 0-for-4.
You’d think that just once in that window, Cal would either handle the pressure (2007, anyone?) or exceed expectations. And yet it has repeatedly failed at both.

Indeed, 2007 was disappointing.

I think he tries to construct an argument that Cal chokes but doesn’t really construct a solid argument (typical Wilner). Perhaps Cal’s “clutch” play improves with time and experience.

I think 2007 is only the real season where you can say Cal failed to meet expectations set by pre-season polls.

What about all the other games Cal won when they were ranked very high? Those are magically forgotten by Wilner. It only takes one losing game to forget the past five winning games. I understand that. But Wilner is clearly just looking at 1 to 2 specific games where Cal loses big games when ranked very high to prove his point while ignoring many other games that Cal won when ranked very high. In other words, when Cal loses a big game while ranked high Cal can’t handle the pressure but when Cal wins a big game while ranked high it doesn’t mean Cal handled the pressure. Right… double standard there. Wilner is a joke.

To elaborate: all teams lose games. Wilner is obviously setting the bar very high. He is basically requiring that Cal goes undefeated or finishes the season with only 1 loss to qualify for “handling the pressure.” By setting the bar that high, 99% of NCAA college football teams will have failed to handle the pressure. Wilner fails to recognize how hard it is to win games. He has essentially set a USC standard for all the other football teams which is unreasonable.

What Wilner is trying to say is that Cal might need a USC standard to get to the Rose Bowl. What do you think?

Your Result:

You’re Jean Valjean from Les Miserables, by Victor Hugo. You were unjustly imprisoned for 19 years, and when you got out, you devoted your life to helping others around you, while at the same time you evaded authorities. You helped a prostitute’s daughter, and forgave all your enemies. You died at a nice old age, with your loved ones at your side. Aww.

That’s all true, except for the ‘being-a-guy’ part.

Colorado has at least 5 Nationally Televised Games

And some quotes:

Big 12 officials announced the telecast times for 2009 football games that have been selected to be aired on ABC, ESPN, FSN and Versus.

The list, released Monday, includes 14 telecasts on ABC or ESPN. Nine of the games are part of the Big 12’s conference package and five will be aired as nonconference road games. Of the 19 games selected, eight will be played on days other than Saturday.

Colorado emerged as the early leader for guaranteed air time, with five telecasts. Texas, Oklahoma, Oklahoma State and Missouri were selected three times. Texas Tech and Nebraska have two guaranteed telecasts. Texas A&M, Kansas and Iowa State have one appearance each.

I’m pretty sure that Texas and Oklahoma would say that Big 12 contracts suck too, because they also have just 3 games and I think they are better than Colorado.

I think the answer, Chowder, is in the fact that games will be played on days other than Saturday. If we had the flexibility to schedule games on a Thursday night, for example, we’d probably pick up another game or two because we wouldn’t be competing for air time with other big schools.

You can dabble, but look out a bit further

Simple answer is NO. Before I’d put my cash to work in the markets, I’d wait for the “Obama Recession.”

If you look back in our history (or Japan’s), market recoveries always form a chart pattern called a “double bottom.” Meaning the first recovery almost always stalls and then we fall back into recession again. Frankly we’re not even out of the first one.

Generally when disaster strikes, congress and the Fed usually will team up to do something about it… fiscal and monetary policy to get the economy moving again. But usually the problems that caused the initial crash are much more systemic to just put a band aid on it. The initial recovery is almost always overtaken by the systemic problems that caused the crash in the first place. Then we have the second crash. Then inflation. Rinse and repeat.

Smart traders make money by being patient and recognzing patterns through the noise. You can also make money by recognizing when patterns are broken, but not consistently.

“The Obama Recession”
This is what the conservative pundits will try to call the second crash… even though Obama would have very little to do with the cause. Have you ever heard of the “Roosevelt Recession?” … this is the second crash shortly after the New Deal. Conservatives collectively launched a PR campaign to name the second crash after FDR, even though he had very little to do with it at all. Frankly… the first and second crashes should have been called the “Coolidge Recessions”… and of course Hoover has something to do with the Wallst bubble…but I digress. Most textbooks saw through this BS but there are a few textbooks out there that still call it the “Roosevelt Recession.”

Anyhoo… wait for the second crash before you go ape shit in the markets. Low skill service sector jobs go first in a recession… then unionized manufacturing gets hit (where we are now)… then sticky service jobs get hit (we have yet to hit this milestone). Sticky service jobs are last to go b/c usually it costs alot to fire them and it costs a ton to re-hire them later (it costs about 20-40K to hire a single investment banker…really). Plus it’s b/c they usually have the highest revenue-per-employee ratio. Once we get here then I"d be looking for the second dip… I’ll be buying THAT rally for sure…. well, not me since I’m not allowed… but I’ll be telling my clients to be buying.

by danzig on Jun 2, 2009 1:46 PM PDT up reply actions   1 recs

Good stuff as always. And actually I heard something about the Roosevelt Recession…wasn’t that in 1937 (8 years after the initial crash)?

by Avinash on Jun 2, 2009 1:54 PM PDT up reply actions   0 recs

I didn’t know that… but it’s generally agreed upon that it wasn’t the New Deal legislation that caused the “Roosevelt Recession”… which was my point. Which is what Fox News pundits will try to peg on Obama’s stimulus package. I promise you.

I didn’t want to get into a huge discussion about this…. but the New Deal was very bad for big business and the wealthy… real bad. This created ALOT of enemies that wanted to hang FDR. Part of the reason why the New Deal was never allowed to play out was because before it got started the New Deal was stopped by FDR’s enemies in the congress and especially in the conservative dominated Supreme court where the New Deal was ruled unconstitutional. They also deemed FDR’s child labor laws unconstitutional as well… seems laughable today… but it’s true.

Between ‘29 and ’37 there’s an “interventionist” recovery… but if you leave it alone (what the FDR’s enemies wanted) there’s going to be a flat-line between ’29 and ’37. Small recessions you leave alone, crashes you do not… you try your best to minimize the suffering and human tragedy.

Conservative economists have a big problem… they focus too much on GDP and the performance of the DOW. They don’t look at median per-capita-income and standard of living… which is really what we should be looking at. The employment rate itself is totally misleading. And they totally ignore human suffering.

I’ve read Grahm and Dodd… I used to believe that maximizing shareholder value helps everyone… that’s what I was taught at school (yes at Cal). But I no longer believe that. I’ve seen the economy action and have made a living by watching the markets and I can tell you there’s a disconnect between free-market capitalism and improving the lives of the masses. What I’ve learned is if you have a completely free economy with few rules… you don’t have a happy society…. what you have is Somalia… or Liberia. The opposite end of the spectrum is just as bad, incidentally.

In reality, when you look closely, they are unconstitutional!…crazy. But as any law student will tell you.. the constitution has HUGE gaps in it…. which is why the supreme court exists. I think you’ll agree.

Back to the point: let’s face it… if you’re in the law profession you’ll know that the supreme court exists not the differentiate between black and white… it’s there the rule on the grey areas.

There are tons of steps you need to take to bring a controversial issue all the way to the supreme court… numerous appeals are just the start. By the time you get to the big show… it’s no longer about the letter of the law… it’s about determining what’s right and wrong…. full stop.

Politicians know this, the congress knows this, presidential candidates know this… and the media certainly knows. Implicitly, I think the public knows as well.

In the case of the supreme court during FDR’s time… I think you’ll agree, they weren’t a friend of FDR and the New Deal. They were ruling, not based on decency, but based on what was against FDR.

I mean, I have no idea…I don’t even know the case you’re referring to, at all.

All I was thinking of during my post was that at the time the constitution was written, long hours and child labor wasn’t just commonplace, it was the norm, with 24/7 apprenticeships forming the backbone of skilled labor education. I could easily see that FDR’s creation of a federal law dictating child labor laws might be interpreted to violate the 10th amendment: that

the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

As for whether the businesses were just being douches and trying to stick it to FDR, well I’ll take your word for it.

Fuck, its switch in time saves nine. Not stitch.

"The switch in time that saved nine" is the name given to what was perceived as the sudden jurisprudential shift by Associate Justice Owen J. Roberts of the U.S. Supreme Court in West Coast Hotel Co. v. Parrish.1 Conventional historical accounts portrayed the Court’s majority opinion as a strategic move to protect the Court’s integrity and independence from President Franklin Roosevelt’s court-reform bill, which would have expanded the size of the bench up to 15 justices.

The term itself is a reference to the aphorism “A stitch in time saves nine,” meaning that preventive maintenance is preferable.2

Yeah, the courts were no friend to FDR’s New Deal. It’s the reason he tried to pack the Supreme Court in the late 30s (increasing the number of judges to 11/13), arguably his biggest failure as a president.

by Avinash on Jun 2, 2009 4:31 PM PDT up reply actions   0 recs

I don’t think long hours of child apprenticeships was what FDR’s child labor laws were making illegal, do you? I think it was the fucked up ways factories were abusing cheap child labor that forced FDR to make a law against it.

Nor do I think it was trying to encroach on federalism… it was trying to prevent low skill, factory line-jobs being filled by millions of uneducated children who should be in publicly funded schools, learning to read. This was a huge problem back then.

As for whether the businesses were just being douches and trying to stick it to FDR, well I’ll take your word for it.

This is just my opinion… just like everything on this blog. But would you like another Coolidge and Hoover, back-to-back, today? Are you really saying that the Supreme court during FDR’s time was impartial and unbiased?

Like ALL supreme courts and supreme court appointments… there’s always going to be some political bias… that’s why it’s so important to fight over them… if ti were unbiased… then why fight over it?

by danzig on Jun 2, 2009 4:32 PM PDT up reply actions   1 recs

I don’t think long hours of child apprenticeships was what FDR’s child labor laws were making illegal, do you?

Well, yes, they would make those apprenticeships illegal (which, by the way, were completely nonexistent by that point and had been for years due to the industrial revolution). Were they AIMED at those apprenticeships? No way.

But my point remains: you list excellent reasons exactly why those child labor laws should be enacted,

trying to prevent low skill, factory line-jobs being filled by millions of uneducated children who should be in publicly funded schools, learning to read
but the thing is, in the eyes of the law, potentially, none of that matters.

Again, FDR’s aim was not to encroach on states’ rights. It was to protect children. If I’m Factory Owner McFactoryOwnerson, and all of a sudden the federal government enacts laws that will raise the cost of production immensely, of COURSE I’m going to try and fight it, even if it’s immoral to do so. How would I fight it? By pointing out that it might violate the 10th amendment. Again, ethics and morals don’t ever come into play. Yes, the kids SHOULD be in school and I SHOULDN’T be making them work backbreaking jobs for pennies. But, technically, if it is legal to do so, as a businessman I’m going to fight for my right to earn as much profit as possible.

Now back to me, Spazzy. Of course I don’t want another Coolidge and Hoover, but I am suggesting the possibility that the supreme court could, in this case, be construed as impartial and unbiased relative to FDR based on the evidence suggested. Is that necessarily a good thing? No way.

Not to be a pedant...

But, as you acknowledge later, the types of child labor that existed from 1787-1789 are probably not what the common perception of “child labor” we have today. What you’re describing here,

All I was thinking of during my post was that at the time the constitution was written, long hours and child labor wasn’t just commonplace, it was the norm, with 24/7 apprenticeships forming the backbone of skilled labor education.

is basically modern vocational school, or training in an artisanal craft, and the chief option for those who did not wish to be a farmer of some sort. Unpleasant as such an apprenticeship may have been at times, it cannot really compare to the squalor in which the Lowell factory girls and their ilk later lived. Universities (e.g. Harvard, Yale, William and Mary) were still primarily devoted to training members of the clergy, though I believe graduate schools for law, etc. were becoming more common. (This is not a hard and fast rule obviously; Thomas Jefferson went to William and Mary.)

So, I don’t think James Madison, John Jay, and Alexander Hamilton as well as the other Constitutional Conventioneers had much of a sense of what future generations would endure in terms of working conditions in the effort to industrialize, and therefore their concept of child labor (e.g. learning a skill) and the protections given to it within the Constitution did not seem terribly inhumane. Quite the opposite actually, as it represented the traditions of several centuries, both in the U.S. and in England before that.

Well, that was exactly the point I was trying to make. The industrial revolution and the massive factories it spawned and energy it required was a century away. The founding fathers had no idea of the labor requirements it would foster. That is why there were no “child labor laws” written in the 1780’s: apprenticeships WERE child labor and they were nothing like what would come in the late 19th century.

That’s why, since it is not explicitly written in the constitution, businessmen had the right to sue over federal child labor laws 150 years later: the foible that the type of labor they were employing did not exist at the time the constitution was written.

praise be to Bak Bak somebody also sees this:

To truly silence the BCS bashers, the Pac-10 would have to jump into the fray. The league reported only $88.78 million in gross receipts for the 2007 fiscal year, putting it far behind the ACC, Big Ten, Big 12 and SEC. That’s partly due to the nation’s worst TV deal, but Pac-10 officials also are passing up on the championship game gravy train. Since Pac-10 coaches want to discontinue round-robin scheduling anyway, the next-best way to crown a conference champion would be the one that would make the most money

I love how the Pac-10 is consitently roasted and told how it needs to expand to 12 teams while the Big East continues to skate by with only 8 mediocre programs. Yeah, that’s totally fine.

It'll be just you, me, and Peter Nincompoop.

by BeastMode on Jun 2, 2009 2:05 PM PDT up reply actions   0 recs

And, for the record, Penn State and Notre Dame should join the Big East. They won’t, but it makes by far the most sense. Notre Dame has a huge East Coast following with a lot of alumni in NYC, Penn State would have a natural rival in Pitt, and both conferences would have an even number of teams (i.e. 10). Of course, this would dillute the Big Ten somewhat, but with the ascendancy of Michigan State in addition to Ohio State, Michigan, and Wisconsin, the Big Ten will still have a decent top half. The Big East on the otherhand will look much stronger with Notre Dame, Penn State, West Virginia, and Pitt as its premier programs.

It'll be just you, me, and Peter Nincompoop.

Reasonable list, but that is a very old time from Best who hasn’t been timed in the 100m in a while. Holiday, Demps, and Ford may yet be faster, but Best has to be fourth. And, the only speed that matters is football speed and Best is second to none.

It'll be just you, me, and Peter Nincompoop.

it’s just a 100 m time list…and none of these lists were compiled at the same track with the same conditions. Sure, they’re all fast but which one is faster is hearsay, imo.

Heaps and Hinder...come on down!

by carp on Jun 2, 2009 2:56 PM PDT up reply actions   0 recs

Some real questionable reasoning:

Demps and Holliday both have a best of 10.01 in the 100m, making them the two fastest college football players of all time based on the short sprint, but I give the title to Demps for a couple reasons. First, he has topped out at 21.04 in the 200m (to 21.33 for Holliday, who is basically a 100m specialist), indicating to me that he has more ability to maintain his speed down the field

A 200 time is irrelevant as a tie breaker for fastest football player. Nobody ever runs 100m in a line in a football game, let alone 200. There’s a reason they run the 40 yard dash at the NFL combine instead of a 100m dash. Plus, the 3rd guy on his list has the best recorded 60m dash time, meaning that in a football sense he’s fastest.

Wait, why am I micro-analyzing a meaningless, poorly understood blog post?

Jim and about 5 other coaches are on a morale tour visiting troops overseas. The gym was almost all Ohio State fans, it was hilarious. The UCLA coach came in first and started to talk to the OSU “side”. Tressel walked in and the whole place just ignored UCLA and started chanting OH-IO…..it was awesome. I got Tressel’s book, for free of course, and he signed it, a hat, shirt, and some photos…yea!!!

YOkanes:

I got off the phone with Deputy Director of Athletics Steve Holton a few minutes ago and found out a couple of interesting things:

–Because of the poor economy, coach Jeff Tedford has agreed to have the team bus to the UCLA game this season rather than fly. The Bears usually take charter flights to all road games, but the UCLA game is close enough that the team will travel by bus and save the athletic department a good chunk of change.

–The seating capacity at the renovated Memorial Stadium will be about 62,000. That’s a little lower than I first understood the plan to be, but Holton said the designs always had the capacity being slimmed to around that mark. The exact capacity still hasn’t been decided, but it will be about 10,000 seats less than what it is now.

Danzig, thoughts on this?

LINK

Google set out to digitize the world’s books in 2003, got sued for its trouble in 2005 by publishers and authors wanting to make money from the efforts, and in 2007 came to a proposed settlement that gives Google the rights to scan, index, display and even sell millions of books that are in copyright. So far its Google Book Search program has digitized around 10 million books from the some of the nation’s most prestigious university libraries, but only small portions of most in-copyright books are shown online currently.

(Learn more with Wired.com’s Google Book Search Settlement FAQ.)

Even the deal’s critics — such as New York University professor James Grimmelmann — admit that the deal sounds great: Books in copyright but out-of-print become available for viewing and purchase by the public, and researchers and students at universities will get access to the full technology.

But Grimmelmann, whose Google Book Search research has been funded by Microsoft, says that the Google deal gives it exclusive rights to books that are in copyright whose authors can’t be found — so-called orphan works — and that any competitor who wants to try the same project could get sued for huge sums of money.

That makes a monopoly, Grimmelmann told conference goers at the Computers, Freedom and Privacy conference in Washington, D.C. Tuesday.

"On Day One, it will be illegal for anyone else to do what Google is doing," Grimmelmann said.

Helois launches "India Jai Ho Fund"

Because I cannot make this stuff up

June 2 (Bloomberg) — Helios Capital Management Pte, the hedge-fund manager once backed by Tudor Investment Corp., plans to start a "Slumdog Millionaire" fund that will buy underperforming shares of Indian companies.

"We want to find slumdogs from the Indian equity markets who have the potential of becoming millionaires," Samir Arora, founder of Singapore-based Helios Capital, said in an interview.

The firm plans to raise about $50 million by the end of July for its long-only Helios India Jai Ho Fund, Arora said. "Jai Ho," which means "victory" in Hindi, is the Oscar- winning theme song from "Slumdog Millionaire," a feel-good tale of a Mumbai orphan’s escape from poverty that scooped eight Academy Awards, including best picture, this year in Los Angeles.

I don’t have one. But its arriving like tomorrow so we can single out YF again!

While the rides on the Pain Train and Brock Mansion Party Yacht have been fun, I think its time I hop on the BakBakcycle.

Im not entirely sure I know what a Xbox 360 is.

I am the Tyrant Boy King Of UC Eugene! An endless cavalcade of worthless inanities is my currency!

Will this game play on my totally modern-and-up-to-date PS2?

I haven't seen that many tear-stained dollar bills since my dad hired a stripper for my uncle's funeral.

I’ve got a PS3 and a Wii, along with a PSP and a DS (but not DSi). The Xbox 360 is the only thing I don’t have.

Buffalo doesn't want TO actually moving in
Owens, who still is searching for a place to live, posted a message on his Twitter page Tuesday night:

sittin here trippin about residents @ 1 DEER RUN wn’t rent 2 me b/c they said they dn’t want any drama n their neighborhood!! LOL!!! Wow!!

There is a house for sale or rent at 1 Deer Run Ct. in suburban Orchard Park, where the Bills train and play. List price for the 4,002-square-foot, six-bedroom home is $489,387 (how do you come up with that number, anyway?), while the monthly rent is $2,950.

So Owens is good enough to receive a key to Buffalo, but some folks don’t want him moving in.

Still holding out hope that Ryan Anderson will capitulate and grant him that interview he's been asking for for months now.

I’d be Captain Spaulding from “Animal Crackers”. I can’t understand how my mind works, but I just know it does. And it’s hilarious.

Spaulding: One morning, I was sitting in front of the cabin, smoking some meat.
Mrs. Rittenhouse: Smoking some meat?
Spaulding: Yes. There wasn’t a cigar store in the neighborhood. As I say, I was sitting in front of the cabin when I bagged six tigers.
Mrs. Rittenhouse: Oh, Captain!
Spaulding: Six of the biggest tigers…
Mrs. Rittenhouse: Captain, did you catch six tigers?
Spaulding: I bagged them. I…I bagged them to go away, but they hung around all afternoon. They were the most persistent tigers I’ve ever seen. The principal animals inhabiting the African jungle are moose, elks and Knights of Pythias. Of course, you all know what a moose is. That’s big game. The first day, I shot two bucks. That was the biggest game we had. As I say, you all know what a moose is? A moose runs around on the floor, and eats cheese, and is chased by the cats. The Elks, on the other hand live up in the hills, and in the spring they come down for their annual convention. It is very interesting to watch them come to the water hole. And you should see them run when they find it is only a water hole. What they’re looking for is an alco-hol. One morning, I shot an elephant in my pajamas. How he got in my pajamas I don’t know. Then we tried to remove the tusks…but they were embedded in so firmly that we couldn’t budge them. Of course, in Alabama, the Tusk-a-loosa. But, uh, that’s entirely irrelephant to what I was talking about. We took some pictures of the native girls, but they weren’t developed, but we’re going back again in a couple of weeks.

One of my favorite Groucho monologues ever...

CGB: Our points are reliable. Our logic is infallible. Our past records are illogical. And our ham is dynamite!
