FINAL REMINDER
City Hall Meeting Today at 5. I just spoke with CBKWit and he said the meeting with Councilmember Capitelli went well. However, this process is not over yet. Everybody's presence is more important than ever! As noted in the DBD, Volker really filed some sort of appeal. If he gets the Council on board, this could be BAD!
If you cannot make it at 5, do not worry. It was emphasized at the meeting that everybody who wants a chance to speak will get that chance. So, if you can come at 5:30 or even 6 or hell even 6:30. I predict it will be an insane circus and the public session will go for a while. Make your voices heard!

Meeting did go well (knock on wood) except for some loudmouth/vitriolic young guy in a red shirt who seemed intent on pissing Mr. Capitelli off. I was glad it didn’t turn out to be CBK. Actually come to think of it it was probably a furd.
And Mr. Capitelli said, basically, “if you want your voices to be heard by the council, the best way is to go to the friggin meetings.”

Just to clarify, was Capitelli pissed that people hadn’t shown up before and argued against the suit?
It seems that way from the 'friggin' you quoted.

pissed? No, not at all. In fact I shouldn’t have put in quotes. THAT’S NOT A DIRECT QUOTE, EVERYONE.
He just said, basically, that showing up in person is a lot better than emails.

Spazzy and I were the best looking

Maharg went to the meeting? But he’s been commenting here all day!

Hippy Email
Dear Tree-sit supporters,Good news. Yesterday some “squirrels” climbed up into a tree and
managed to send six bags of food to the tree-sitters! (Two new tree-sitters
went into the grove, as well.) Watch the Berkeley Citizen video here:http://www.youtube.com/watch?v=hs0g9UTgB5Q
Ground supporters negotiated a deal with UC Police: in exchange for
dismantling the new line that was strung to the redwood tree, UC police
will allow one bag of food to go up to the tree-sitters every day.Tree-sitters are asking for dried fruits, nuts and seeds, sproutables,
and fresh food (e.g. produce) every day.So please – bring your food to the grove, so it can go up to the
tree-sitters! Come by whenever you can.If you have questions please call the ground support phone at
510-938-2109 (calling is better than emailing).Thank you,
The Oak Grove Tree-sitters
PS Don’t forget PLEASE come to the city council meeting today
(Thursday) before 5pm and get on the speakers list and ask the city to appeal
the lawsuit. Meet at the grove at 3:33pm, march to city hall, rally at
city hall at 4:44pm.
Well then, jolly squirrels, lets head on down to city council, shall we?

Hey Twist, I just heard on california.scout.com that the PHA was appealing the case too? Any validity to this rumor? http://mbd.scout.com/mb.aspx?s=166&f=1419&t=2716482 (I figured the hippies would, but PHA would surprise me).

both PHA and Oaks are listed. the only question is whether the city will join them.
personally, i doubt either group’s ability to post a bond in the improbable case where a new injunction is imposed.
So, basically, you gotta Go Bears!

We started discussing this in the DBD. Take my complete and total lack of nolej about CEQA and AP law and divide that by infinity to get my nolej on appeals law. However, OakTownMario, resident legal scholar, notes this in his post.
nothing earth shattering and basically simple procedure preserving the opportunity to file the appeal
Somebody over there noted that Volker filed both of these appeals, so he might just be doing this for the PHA, I don’t know.

Just noticed
Just noticed this, hasn’t been put up on the court site quite yet.
07/24/08 Notice to Attorney re Notice of Appeal Filed
Any idea what this could be??? I’m hoping for a ‘F—- You Volker, you can’t file an appeal. – Sincerely, Judge Miller’

It might just be a proof of service that they noticed Olson about the Notice. Although not 100% sure, I am going to assume that filing this appeal doc rises to the level to require notice. So, Volker and Co. would have to notice all interested parties. Off the top of my head, that might be what ti is. I like your idea better, tho!
