Court Ruling And Tree Sitting Open Thread
Well, first we went deep undercover on Saturday at hippie training. Then, on Tuesday, we had our man on the scene as the process of bringing the tree sitters down began. He'll back taking photos and collecting stories today. But there's a lot more going on than just taking down (potentially) the tree sitters and the trees. Let's use this as an Open Thread to discuss a)what's going on at the grove and b)the Judge's ruling, which comes out today.
And please, post any photos and stories from the grove from today or yesterday, people! Big day today, people! Historic times! GO BEARS!!!!

Let's hope the decision comes down today
but don’t be surprised if its is delayed.
I’ll see if I can find the order where the judge set this deadline, but if it was self-imposed the judge can just as easily disregard it for a few days.
I checked on the court website earlier and saw that attorney for the California Oak Foundation filed a Letter with the Court yesterday, and UC Regent attorney Charles Olson filed a Letter today. Unfortunately the court website doesn’t upload these letters right away, so unless someone is near the court and can get a copy, we don’t know what the hell the letters are about (maybe they’re about the tree sitter removal?).

The letters have been posted now
One is requesting that regardless of the ruling, the injunction on the trees be maintained to allow time for the filing of appeals and whatnot. The other is strenuously, and I do mean strenuously, objecting to such a request.

sounds like Plaintiffs are grasping at straws. The Plaintiff letter also requests calendaring dates for motions for new trial, reconsideration or the like, and establishing dates for hearing on these issues. Defendant’s letter basically says “Fuck off. You had enough time to argue all of this a long time ago. We object to this dickhead’s letter.”

I agree with both of these assessments. I tried to read CCP 1094.5, which the plaintiffs reference, but it was long and boring (kind of like having sex with me!), so I quit.
That said, my nolej of domain web is not the greatest. In the judgment section, is that where they post the judgments? I’ve only ever done Probate Actions in Alameda and never really dealt with the judgement section. Is that what I should be refreshing over and over and over again?

kind of sucks and needs to be upgraded.
That said, my understanding is that any time anything is filed (including a judgment), it will be registered on the “Register of Actions” so that is what I keep looking at (although sometimes a decision can appear on both the Register of Actions and Judgments). DomainWeb doesn’t let me “refresh” the Register of Actions. When I try to, it shoots me back to the page where you have to click on case summary, and then enter the case number all over again, etc.

I checked Rulings And CMCs, Judgement, and Register of Actions as of 11:50 AM and there is nothing there yet. Agreed the Domain Web kind of sucks, but whatever.
Given the obvious media attention, they might give it to the media first or something. But I’ll keep checking. This makes it easier than ever to make it look like I’m working!

1) The Berkeley Grandmothers for the Oaks say, “Please come to the grove early morning today (Wednesday)!! Please arrive as early as possible… 6am or 7am if you can… and join in our vigil to keep watch on continued UCPD attacks on the tree-sitters. We will be there all day and night and we’re hosting a slumber party Wed night, so please bring a sleeping bag, help us hold the space and keep watch.”
2) What happened yesterday… UC Police conducted a massive raid on the grove. UC’s climbers attacked and arrested a tree-sitter, and cut down numerous support platforms and supply lines. Tree-sitters are concerned that UCPD might continue operations and attempt to remove more tree-sitters. More details on what happened at:

After a morning that saw UC campus police and their tree climbers removing traverse lines and tree sitter supplies, the university called a press conference. As the press corps gathered at the north end of the stadium, UC Berkeley spokesperson Dan Mogulof recounted the morning’s activities. When asked about the fate of the tree sitters he said, “At this point, we don’t see a way to physically remove the people in the trees in a manner that minimizes the chances of anybody getting hurt.”However, less than an hour later, UC’s climbing team returned to the grove and began a second assault. This time their aim was the removal of the tree sitters. The extraction team moved in on one of the lone female sitters known as “Millipede” who hung suspended on a traverse line.
As they maneuvered a large basket crane into position, the extractors banged into her several times. Her screams could be heard all over the grove as more than a hundred supporters watched below. Millipede was wrestled onto the platform and lowered to the ground. Campus police immediately arrested her and took her away.
It is doubtful that any of those working with the UC police in the trees today were trained in tree extractions. Clearly, their actions were cause for concern. UC can only be thankful that no one was critically hurt.
Please come to the Oak Grove now. We need your support and to bear witness to UC police actions.

This Berkeley Daily Planet reporter was threatened with arrest after he questioned an officer’s order to leave the rim of the stadium, the only place where activities of the officers could be monitored.As the reporter was leaving, he was shoved in the back by a university officer and would have fallen down the concrete stairs had not he been grabbed by Doug Buckwald, one of the long-time supporters of the tree-sit.
Officer C. Chichester, Badge 36, told this reporter, who was carrying valuable camera gear, that if he were arrested, "who knows what would happen to your camera equipment when you’re in jail?"
The stadium rim was the only place from which a journalist could have a view of the events unfolding in the grove below. It was from the rim that the reporter saw one of the cranes brush a support line, from which a tree-sitter was suspended between two evergreens at least 50 feet apart.
Had the line snapped, the protester would have been hurled to the ground in a potentially fatal fall, and for that reason the reporter protested the forced move.

Day two
There were a lot more people out watching today, including more hippies. They even set up a table with food. Not a whole lot happened earlier this morning as the arborists were working, aside from some hippies trying to argue with spectators. But about an hour ago, the woman in the treetop nest(?) started screaming hysterically, and everyone kind of moved over there. The arborists were cutting some rope that was apparently really bad to cut, and the woman kept screaming about it, but then nothing happened. The treewoman was doing her best to fall off her perch, she was shaking it as much as she could. I saw a guy with a bo and long hair, I wonder if it’s the same guy you saw on Saturday? And I think the shitbombs all got used up yesterday, cause I didn’t see a lot of poo flinging today. I guess they planned for a battle, not a war.
My friend brought his camera, so hopefully I can post pictures later. There were a lot of cameramen there, and a helicopter overhead, so I’m sure there’ll be more pics in the media as well.
Well, if you see CBKWit’s post below, there are photos of the guy with the long bo who was there yesterday. Was it the same person you saw today? I’m going to make a assumption that, given the dearth of long bo wielding hippies in general, it is the same person.

is that if they want to save trees why don’t they go hang out in mass logging operations or in clearcut operations all over the world where McDonald’s is making space for cattle grazing? What is a victory?
My posts aren’t showing up. Any advice?
My question is, is there a result that doesn’t allow immediate construction that we could consider a win? I want to buy a plane ticket back to the states, buy a paintball gun and a chainsaw, go to work, then build my mom a new fence.
If my understanding is correct, Cal cannot really lose here, in the way that the plaintiffs wants. The worst Cal can do is be forced back to the drawing board to go through the process again. It would suck a lot and take more time, but I’m sure Sandy Barbour would soldier on with the project. My understanding is that they cannot stop it, merely delay it.
Moreover, unless the plaintiffs’ last ditch attempt (i.e. those letters as noted above) is successful, the injunction is dissolved and Cal can move forward with the plans. Breaking of ground for the project triggers some contract provisions in Tedford’s contract which makes it tougher for him to get out of the contract. So, I think even if we “lose” today, we still “win” because the injunction is dissolved. But god knows I’ve been wrong about stuff before.

That's my understanding also
especially because I recall reading that at the time UC was sued, their plans had not even been finalized. So even assuming worst case, UC could simply revise its plans (if in fact they are found to violate the Act). I just don’t see how a judge can rule against Cal on this matter and I think Plaintiffs know this – that’s why they filed the letter requesting continued injunction.
FWIW, Plaintiffs’ request for continued injunction if they lose may not be appropriate given that generally once the Judge issues a final decision, she is divested of further jurisdiction on the matter – although there always seem to be exceptions.

The ruling is whether or not the athletic center is ‘part of’ the stadium, meaning that it would be built on top of a fault line. If she thinks it is, the architect takes a couple of days to file a revision that makes the center completely separate (and much less useful), but it still gets built. Bottom line, no more trees.

Unless the Judge has completely lost her mind and joined a hippie combine, I fail to see how she could possibly rule against the UC based on the legal merits of the case alone. The tree sitters and the city simply have very little going for them in regards to their legal arguments. What I would like to see is the State attempt to recoup some of our lost tax dollars, both from the city and the tree sitters. From what I understand some of the tree sitters are trust fund biatches, which would make their parents a nice target for lawsuits. I would definitely like to see all of their lives ruined, and eternal damnation would also be nice!

Hey Twist, I also found the comment of the hippies demanding that we negotiate with them infuriating. We have tried negotiating for I don’t know, 18 months? They don’t want negotiations, they want complete capitulation. The only negotiating they’re interested in is the UC declaring this project dead. They make me sick, and the newspapers who never ask follow up questions to their grotesquely egregious responses make me even more sick! I am glued to this site waiting for the ruling. what sort of legal punishment might the tree people face? im very confused about why the hippies are able to get away with some of the crap they pull. Example- in one of the threads there is a photo showing a treesitter holding wirecutters. Nearby are two workers on a platform. The caption reads “A tree-sitting protester swings a wire cutter at workers ” To me that sounds like a pretty serious crime…
I am not a criminal lawyer, so I cannot speak to what the punishment is. I have read that the DA is not interested in taking any cases involving these protesters due to the politically charged nature.

it would be more trouble than its worth, and considering the disgustingly enormous amount of $$$ already spent dealing with these people, a costly court battle is the last thing anyone needs.
There are a lot of minor violations involved here
trespassing, violation of court order, public nuisance, and I’m sure throwing crap must be among those. I would think the more serious violations are attacking a police officer and throwing crap/urine.
As Twist said, it really depends on the politics involved. I would think the DA wouldn’t charge anyone for trespass but if he doesn’t want to piss off the cops he will probably file charges against those that attacked officers. But again, it depends on politics. I doubt any of these stinky hippies will see any significant jail time.

It should be a crime to build an illegal structure on state property and defy a court order asking them to vacate. It should be a crime to threaten and incite violence, resulting in serious bodily harm, as the hippies have done. It should be a crime to merely be a hippie, as the hippies are hippies.
Oh and what happen to loving and respecting mother earth and everything else? Something tells me the trees do not appreciate having nails hammered into them and being molested by the hippies. In fact just the other day I interviewed one of the oak trees (see the hippies say the trees speak to them, well they also spoke to me) and they were all pretty much unanimous in saying that they would rather be chainsawed right now then go on after what they have had to endure for the past 18 months. Even if the judge rules against the UC most of the trees will die anyway, as they have been exposed to untold biological toxins emanating from the future corpse rotting bodies of the hippies.
“I wish they would just come and chainsaw us, after what we have been through none of us have the will to go on. The hippies have forever ruined us, raped us, desecrated us! We demand justice against the hippies for what they have done, but in the meantime please, PLEASE CUT US DOWN!”

i've been in an alameda county courtroom...
...objects are moving even slower than they appear. everyone is allowed a chance to repeat themselves many many many times. don’t be surprised to hear about a ruling in the morning at this late hour. the entire court room may have dozed off. i’ve seen it happen.

Well, still no ruling, but there has been one notable update to come out of the media around a midday incident. The tree-sitters have built what looks like a new platform well above the tree-line that they’re calling the "God pod" and looks like a crud crows-nest in an old ship well above the sails. My guess is that it was done overnight. In any case, the point of this platform is to put the tree-sitter in a precarious position where any attempt to either compromise the platform or to remove the tree-sitter will likely result in a VERY long fall. There’s no other branches or ropes or anything to prevent a disasterous collapse/fall.
